USER AGREEMENT

If you do not agree to the terms and conditions set out in these Terms & Conditions of Use, you must not use the Website.

These terms and conditions constitute the sole record of the agreement between you and onhighstreet.com with respect to the use of the Website. Neither you nor onhighstreet.com shall be bound by any expressed or implied representation, warranty, or promise not documented in these Terms and Conditions. Unless otherwise stated, these terms and conditions replace all prior commitments, undertakings or representations, whether written or oral, between you and onhighstreet.com.

AMENDMENTS TO TERMS & CONDITIONS OF USE

onhighstreet.com reserves the right to amend, vary and/or replace these Terms & Conditions of Use at any time, and from time to time, at onhighstreet.com sole discretion. Your continued use of the Website will be deemed to be your acceptance of any amendment, variation and/or replacement made to these Terms & Conditions of Use.

Additionally, onhighstreet.com reserves the right to cancel a placed order at anytime owing to unforeseen errors that results in the deal shown on the site being inaccurate- such as price, content etc. Should a cancellation occur and your payment for the voucher (henceforth referred to as voucher) has been received, onhighstreet.com will issue a full refund for the Voucher

REGISTRATION

In order to have access to deals and the ability to purchase a voucher/s via onhighstreet.com you must first register on the website.  Registration will enable you to:

1. Receive information via email and or SMS communications from onhighstreet.com relating to deals being offered;
2. Make an order to purchase a Voucher;
3. Access your account balance
4. Change your preferences, including your preferred e-mail address, geographic location, and passwords;
5. View, otherwise receive and print vouchers you have purchased; and
6. View past Voucher/s that you have purchased
7. When registering, you agree to provide accurate and complete information about yourself and to keep this information up-to-date.

onhighstreet.com reserves the right to refuse registration (or to close an existing Account) where:

1. You have registered, or attempting to register in a fraudulent or illegal manner;
2. You have breached these Terms & Conditions of Use;
3. You have an existing Account.

LEGAL CAPACITY

By making an order to purchase a voucher, you warrant to onhighstreet.com that you are:

1. eighteen  (18) years of age or above; and
2. entering into a legally binding contract with onhighstreet.com with respect to that Voucher.

WEBSITE INFORMATION

Any information that is published on the Website about particular goods and services is based on material supplied to onhighstreet.com by Merchants and other third parties.

You agree that onhighstreet.com will not be held liable for the publication on the Website of any inaccuracies or errors in information relating to goods and services that it has received from Merchants and/or third parties. 2. Any applicable laws or regulations of the Republic of Indonesia.

Any fraudulent, illegal or unauthorised use of the Website shall constitute a violation of these Terms & Conditions of Use. You understand and agree that onhighstreet.com may refer any suspected fraudulent or illegal activity to relevant law enforcement authorities.

INDEMNITY

As a registered user, you indemnify onhighstreet.com (and its employees, directors, suppliers, subsidiaries, and legal partners) from any claim or demand. Including reasonable attorneys' fees, from and against all losses, expenses, damages and costs resulting from any violation of these terms and conditions or any activity related to user’s membership account due negligent or wrongful conduct.

onhighstreet.com makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the Website, the information contained on the Website, you or your company's personal information or material and information transmitted over our system.

USER FEEDBACK/ COMMENTS

onhighstreet.com is not responsible for any material submitted to the Comments/Feedback section of the Website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by onhighstreet.com. We reserve the right to remove any material submitted or posted by you in the public areas, should we become aware that the material is defamatory, abusive, insulting, obscene, indecent and/or unlawful.

Additionally, any material posted which we consider to be in violation of any copyright, trade mark, other applicable Indonesia or international laws or intellectual property rights shall also be removed.

JURISDICTION

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of the Republic of Indonesia without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the District Court of South Jakarta in South Jakarta of the Republic of Indonesia in respect of any disputes arising in connection with the Website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.

TERMINATION

These terms and conditions are applicable to users when accessing the onhighstreet.com Website and/or completing the registration or shopping process. These terms and conditions may be modified or terminated by onhighstreet.com without notice at any time for any reason. The provisions relating to Copyrights and Trademarks, Disclaimer, Claims, Limitation of Liability, Indemnification, Applicable Laws, Arbitration and General, shall survive any termination.

CANCELLATIONS AND RETURNS

Orders can be cancelled if the Voucher/s has not yet been delivered. Once a Voucher/s is delivered, it cannot be cancelled.

OTHER GENERAL TERMS AND CONDITIONS

Nothing in these Terms & Conditions of Use creates a partnership, employment relationship or agency relationship between you and onhighstreet.com.

onhighstreet.com will not be liable for any delay in fulfilling its material obligations under these Terms & Conditions of Use if such delay is due to an act of God, act of terrorism, revolution, civil strife, industrial action, fire, flood, war, public disaster, plague or epidemic, delay in transportation or other cause, event or circumstance outside onhighstreet.com’s control which is not due to any lack of reasonable prudence or foresight.

Any provision of these Terms & Conditions of Use which is held to be illegal, void or unenforceable shall be deemed to be severed and the remainder of these Terms & Conditions of Use read in full force and effect
